1. TERMS (A-F)
(A.) "I MOVE LLC," also known as GOOD CHOICE AUTO TRANSPORT, is an auto transportation broker and NOT the actual carrier or driver. GOOD CHOICE AUTO TRANSPORT’s role is to find a carrier for the customer to transport their vehicle(s) from the point of origin to the point of destination. GOOD CHOICE AUTO TRANSPORT acts as a 3rd party liaison between the carrier and the customer providing contractual information and notating occurrences between both parties.
(B.) "CUSTOMER," also known as the shipper, is the registered owner of the vehicle or an agent or anyone on behalf of the owner, who contracts GOOD CHOICE AUTO TRANSPORT as an auto transportation broker to designate a carrier to transport his/her vehicle(s) from an agreed upon origin to an agreed upon destination as specified in the Bill of Lading. The customer does not have to be present at pick up or delivery since a contact person designated by the customer, may act on the customer’s behalf The customer provides the pick up/delivery addresses, names of contact persons at pick up and delivery, phone numbers, and other pertinent information on the contract.
(C.) "CARRIER," also known as “driver”, is an independent contractor that is designated by GOOD CHOICE AUTO TRANSPORT who agrees to transport the customer's vehicle(s) on a truck from an agreed upon origin to an agreed upon destination.
(D.) "DISPATCH" occurs when the carrier has been officially assigned to pick up and deliver the vehicle(s). At this point, the customer and the carrier have agreed to proceed under contract with the auto transportation service under the terms and agreements set.
(E) “PICK UP” AND “DELIVERY” refers, in the same order, to the point of origin and point of destination.
(F) “COD or “COP” refers when the customer pays the remaining balance to the driver either through COD (Cash on Delivery) or COP (Cash on Pick Up.)
2. CONDITIONS (A-S)
(A.) (1) I, the "customer," understand GOOD CHOICE AUTO TRANSPORT is a broker and is NOT the actual carrier. (2) I agree to pay the deposit toGOOD CHOICE AUTO TRANSPORT for the brokerage service. (3) I shall pay the deposit using my credit card or by other payment methods, if agreed upon between GOOD CHOICE AUTO TRANSPORT and I. (3) In turn, GOOD CHOICE AUTO TRANSPORT agrees to find and designate a carrier to transport my vehicle(s) from the point of origin to the point of destination. (4) In addition, I agree to pay the carrier the remaining balance upon delivery or at pick up, however I choose. (5) Once dispatch occurs, the deposit is paid, or the carrier picks up the vehicle(s), all sales are final.
(B). DISPATCH
(1) I understand, once the dispatch occurs, this contract is fully executed and all sales are final. .(2) Terms and conditions between the carrier and the customer are final, including pickup and delivery locations, the final price, deposit, remaining payment to the driver, unless additional fees are incurred. See (R) ADDITIONAL FEES for more information.
(C) CONTRACT
(1) I understand this contract sent via digital signature, E-Docs, is a representation contract authorizing GOOD CHOICE AUTO TRANSPORT, as a third party liaison, to find and designate a carrier to pick up and deliver my vehicle from point A to point B. (2) GOOD CHOICE AUTO TRANSPORT shall post the vehicle(s) on Central Dispatch, load board, to find carriers to do the job. (3) By signing the contract, I accept the initial offering: price, dates, location, and other pertinent information, including the terms and conditions of the contract.
(D) INITIAL OFFERING
(1) In understand, when the vehicle(s) is posted on the load board, carriers, in turn, can either accept the initial offer of the contract (price, dates, locations, or other pertinent information) or they can make a counteroffer to the contract. (4) When the carrier accepts the initial offer of the contract, an agreement is reached between the carrier and I. (5) GOOD CHOICE AUTO TRANSPORT shall proceed to dispatch the vehicle to the designated carrier.
(E) COUNTEROFFER
(1) I understand, in the event, the carrier makes a counteroffer to the contract, the price, date, locations, or other pertinent information may change. (2) I understand, GOOD CHOICE AUTO TRANSPORT shall inform me about the new terms of the counteroffer. (3) At this point, I may choose to either accept the counteroffer or reject it. (4) If I choose to reject it, I MOVE shall proceed to find another carrier to accept the initial offering. (5) I understand each carrier determines their own terms in the counteroffer. (6) GOOD CHOICE AUTO TRANSPORT is not liable or responsible for any counteroffers.
(F) ACCEPTING THE COUNTEROFFER
(1) I understand, once I agree to the counteroffer over the phone, GOOD CHOICE AUTO TRANSPORT shall send an updated final contract to the email provided for me to sign via a digital signature E-doc with the new terms and conditions. (2) As soon as the deposit is paid, the vehicle(s) dispatched, or picked up by the carrier, I am agreeing to the counteroffer even if I did not sign the updated final contract.
(G) ERRORS AND OMISSIONS
(1) I understand it is my responsibility to check for any errors and omissions on the contract immediately on the same day it is sent. (2) If there are any errors and omissions, I shall correct it by contacting GOOD CHOICE AUTO TRANSPORT. (302) 268-9083. (3) It is my responsibility to ask for a corrected contract via email. (4) Errors and Omissions may include, but not limited to, the pick up/delivery dates, pick up/delivery addresses, pick up/delivery contact info, vehicle type, vehicle status: operative/ vs inoperative, transportation method: open trailer vs enclosed and other pertinent information. (5) GOOD CHOICE AUTO TRANSPORT is not responsible nor liable for additional fees or transportation costs incurred due to any error and omissions.
(H) DEPOSIT PAYMENT
(1) I understand, GOOD CHOICE AUTO TRANSPORT may ask for my credit card on file. (2) GOOD CHOICE AUTO TRANSPORT shall charge my credit card for the deposit at the time the order is dispatched. (3) The deposit represents a portion of my total auto transportation cost and it includes the brokerage service rendered by GOOD CHOICE AUTO TRANSPORT. (4) Once the deposit is paid, all sales are final.
(I) REMAINING PAYMENT
(1) I understand when dispatch occurs and the deposit is paid, I shall pay the remaining balance (COD) or (COP) in cash or certified funds such as: cashier’s check or money order to the carrier. (2) The customer and the carrier may agree upon another method of payment.
(J) SIDE DEALS
(1) I understand GOOD CHOICE AUTO TRANSPORT is not liable or responsible for any side deals, outside the contract, between the carrier and myself, the customer, in terms of payment, pick up/delivery locations, pick up/delivery contact info, additional fees or any other side agreements. (2) The resolution to any issue arising from a side deal is between the carrier and myself, the customer. (3) GOOD CHOICE AUTO TRANSPORT shall not get involved in any way since the side deal is not part of the contract.
(K) SERVICE FULLY RENDERED
(1) I understand once the carrier picks up and delivers the vehicle(s), the auto transportation service has been received, provided, rendered, and completed even when the carrier is delayed for any reason or when the vehicle(s) has been damaged. (2) The total payment of the auto transportation service, including the deposit shall not be returned or refunded to compensate for delays, damage to the vehicle(s), or additional fees. See (U) ADDITIONAL FEES for more information. (3) In case of any damage to the vehicle(s), See (R) LIABILITY and (S) INSURANCE for more information
(L) UNFORESEEN EVENTS
(1) I understand that due to unforeseen events, the carrier may be delayed at pick up or delivery. (2) When the carrier cancels for any reason, the existing contract is terminated. (3) GOOD CHOICE AUTO TRANSPORT has 5 business days (grace period) to find a new carrier from the date GOOD CHOICE AUTO TRANSPORT is notified of the cancellation, either by the carrier or the customer. (4) The deposit shall be applied as credit to the new carrier. (5) Final price of the new carrier may vary. (6) It is my responsibility to ask for a new contract when a new carrier has been assigned. (7) If I post my vehicle(s) on the Central Dispatch load board with another broker and/or use the services of another broker to find a replacement carrier, the deposit is non-refundable. See (N): DEPOSIT REFUND POLICY and see (O) DEPOSIT NON-REFUNDABLE POLICY for more information. (8) It is my responsibility to remove electronic toll tags from the vehicle(s) before the carrier arrives at the pick up location. (9) GOOD CHOICE AUTO TRANSPORT is not responsible or liable for any toll charges incurred along the way.
(M) CUSTOMER CANCELLATION
(1) I understand, if I wish to cancel the agreed-upon auto transportation service for any reason, I must notify GOOD CHOICE AUTO TRANSPORT immediately via email at fredv@goodchoiceautotransport.com and call 302-268-9083, the day before pick up. (2) I may also choose to postpone the service at a later date.
(P) VEHICLE(S) OWNERSHIP (1) I understand and confirm I am the registered owner and/or have been authorized by the legal owner to act as agent for the owner. (2) If acting as an agent, I have been authorized to enter into this agreement on behalf of the owner. (Q) AUTHORIZATION I authorize the carrier’s employees jointly and/or separately to operate and transport the vehicle(s) from the origin to destination specified in the Bill of Lading. (R) LIABILITY (1) I understand in the event of any loss, theft, or physical damage to my vehicle(s) that may occur during transit from pick up to delivery, the carrier is the only responsible and/or liable party, since the carrier is the one transporting the vehicle(s). (2) I understand, GOOD CHOICE AUTO TRANSPORT is not liable and simply acts as a 3rd party liaison between the carrier and the customer providing contractual information and notating occurrences between both parties. (3) In the event of any loss, theft, or physical damage to my vehicle(s) during transit or any issue arising from the transportation service, the resolution is between the carrier and I (the customer). (4) The carrier may choose to use their insurance policy or pay out of pocket to cover the loss, theft, or physical damage. (5) Even, in the event, the carrier refuses to cover or pay for the damage, for any reason, only the carrier may still be legally liable, since the carrier transported the vehicle(s). (6) I understand GOOD CHOICE AUTO TRANSPORT or its employees SHALL NOT be liable for any damage or loss, including but not limited to the following: (7) Any type of damage to the vehicle(s) caused by fire, leaking fluids, battery acids, cooling system antifreeze fluids, industrial fallout, or any other damaged caused by acts of nature. (8) Any type of damage including glass damage, scratches during transportation, which is undetectable due to the vehicle’s dirty condition, weather condition, or nightly condition at the time of pick-up or delivery. (9) Any type of mechanical malfunctions, including but not limited to exhaust assembly, frame alignment, brakes, tire damage, suspension, or running of engines. (10) Damages to the vehicle(s) due to the following: (i) vehicle(s) inability to be driven on or off the transporter on its own power, (ii) vehicles with defective brakes, parking brake, or parking gear. (11) GOOD CHOICE AUTO TRANSPORT shall not be liable for car rental costs or storage fees for any reason. (12) GOOD CHOICE AUTO TRANSPORT shall not be liable for missing personal items inside the vehicle. (S) INSURANCE (1) I understand it is my responsibility, as the customer, to ask GOOD CHOICE AUTO TRANSPORT for the carrier’s certificate of insurance before the vehicle(s) is picked up so I can verify the insurance policy and execute my due diligence. (2) I understand the driver may ask me or the designated contact person at the pick up and/or delivery location to sign the Bill of Lading. (3) I understand the designated contact person at pick up and delivery must be 18 years of age or older. (4) It is recommended to either keep a carbon copy or take a picture of the signed Bill of Lading for my own records. (5) It is also recommended for the contact person at pick up and delivery to take pictures and/or video of the vehicle (s) for records in case of damage. Ideally, the driver should be pointing to the damage in the picture. (6) At delivery, in the event of any physical damage to the vehicle(s), I, or the designated delivery contact person must notate any damage on the Bill of Lading and sign it in order to make an insurance claim. (7) I or the designated delivery contact person must make the insurance claim at delivery on the spot through the carrier’s insurance company, since the carrier transported the vehicle(s). (8) If I or the designated delivery contact person signs the Bill of Lading without indicating any damage on the form, the contact person signing is accepting the vehicle(s) as is (without any damage). (9) Consequently, by not indicating damage on the Bill of Lading, it is understood there was no damage during transit and the insurance company may not cover the claim. (10) In this case, the customer assumes the damage. (11) If a Bill of Lading is not provided by the driver and/or not signed by me or the designated pick up and/or delivery contact person for any reason, the insurance company may not cover the claim. (12) In this case, the customer assumes the damage. (13) It is my responsibility or the designated contact person at pick up and delivery to ask the driver for the Bill of Lading and sign it. (14) Even if the insurance company does not cover the claim for any reason, the carrier may still be legally the only one liable, since the driver transported the vehicle(s). (15) The insurance covers physical damage to the vehicle but does not cover any personal items missing from inside the vehicle or mechanical/electrical issues the vehicle(s) may have. (16) I understand GOOD CHOICE AUTO TRANSPORT, or its owners and/or employees, are not liable or responsible for any loss or damage to the vehicle, nor responsible or liable for personal items missing. (17) Hence, the total payment of the auto transportation service, including the deposit shall not be returned or refunded to compensate for any loss or damage, including for missing personal items. . (T) ESTIMATED TIME OF TRAVEL (1) I understand, due to unforeseeable factors resulting in delays, GOOD CHOICE AUTO TRANSPORT can not guarantee the date and/or time of the pick up or delivery. (2) The dates and times are only estimates since the carrier may get there earlier or later than the established date or time. (3) There are absolutely no guarantees made, expressed or implied, regarding pick up or delivery times or dates. (4) The total payment of the auto transportation service, including the deposit shall not be returned or refunded to compensate for delays, storage fees, and rent-a-car costs. (U) ADDITIONAL FEES (1) I understand I may incur additional fees or price change in the following scenarios: When I, the customer, have 100 lbs. or more of personal items inside the vehicle(s). The carriers shall decide the amount of the additional fee. (2) When I, the customer, change the pick up/delivery addresses, pick up/delivery dates, vehicle type, vehicle status operative vs inoperative, transportation method: open trailer vs enclosed or any other pertinent information on the contract. (3) When there are errors and omissions on the contract including, but not limited to pick up/delivery addresses, pick up /delivery dates, pick up/delivery contact info, vehicle type, vehicle status: operative vs inoperative, transportation method: open trailer vs enclosed or any other pertinent information on the contract. (4) When the carrier pays, on my behalf, the vehicle’s auction storage fees at pick up. (5) When at delivery, the carrier is NOT paid the remaining payment and the carrier leaves the car at their yard or at a storage facility until the remaining payment is made. (6) Storage fees may apply. (7) When at delivery, the carrier is NOT ABLE to locate the delivery contact person and the carrier leaves the vehicle (s) at their yard or at a storage facility until remaining payment is made. (8) Storage fees may apply. (9) When at the pick up location or during transit, my vehicle(s) status changes from being operative to inoperative. (10) When any side deals outside the contract are made between the customer and carrier. (11) Any additional fees incurred shall be settled between the carrier and I, (the customer). (12) GOOD CHOICE AUTO TRANSPORT is NOT liable NOR responsible for any additional fees, including storage or rent-a-car fees. (V.) CUSTOMER AGREEMENT (1) I agree to prepare the vehicle(s) for transportation by removing or securing any items that extend above or out from the standard body dimension of the vehicle(s) (i.e. antennas, fender guards, etc.), all batteries, loose parts, low hanging spoilers, etc. (2) I understand the actual carrier, NOT GOOD CHOICE AUTO TRANSPORT, is transporting my vehicle(s) and it is my responsibility to ask the driver for the inspection paperwork (Bill of Lading) and I or the designated contact person agree to sign it at the pick up and delivery location. (3) I agree to properly disclose on the Bill of Lading any damage the vehicle(s) may have before being loaded on the carrier’s truck and during delivery. (4) I agree to inspect the current condition of the vehicle(s) with the driver and sign the Bill of Lading. (5) Upon delivery, I agree to re-inspect the vehicle(s) and sign the Bill of Lading at delivery acknowledging receipt of vehicle(s). (6) By signing the Bill of Lading, I agree I am satisfied with the vehicle's condition. (7) I understand if I am not satisfied and my vehicle(s) has any damage, it must be clearly noted on the bill of lading before it is signed and I must make a claim on the spot with the driver present. (8) In doing the claim, I understand the only responsible and liable party is the carrier transporting my vehicle(s). (9) Nonetheless, the carrier may choose to use their insurance policy or pay out of pocket to cover the loss, theft, or physical damage. (10) Even, in the event, the carrier refuses to cover or pay for the damage, for any reason, only the carrier may still be legally liable, since the carrier transported the vehicle(s). (11) I understand GOOD CHOICE AUTO TRANSPORT, its owners and/or employees shall not be responsible nor liable for any loss or damage during transit. (12) I agree to pay the carrier the remaining payment upon delivery in cash, or certified funds like cashier’s check, or money order or any other form of payment agreed upon between the carrier and I. (13) I agree to hold harmless Good Choice Auto Transport, its owners and/or employees for any costs, expenses, damages, losses, and claims caused by the carrier that is transporting my vehicle(s). (14) I understand the venue shall be in MIRAMAR, Florida for any litigation arising out of this Service Agreement. (15) I am willingly consenting and accepting the terms contained in this contract. (16) I understand that acceptance of these terms negates the right to dispute the deposit.
(N) DEPOSIT REFUND POLICY
(1) I understand GOOD CHOICE AUTO TRANSPORT shall refund my deposit if the carrier cancels after the 5 business days (grace period) to find a new carrier from the date GOOD CHOICE AUTO TRANSPORT is notified of the cancellation, either by the carrier or the customer. (2) I agree to call my agent at GOOD CHOICE AUTO TRANSPORT and request my refund. (3) If I'm having an issue with the refund, I will send an email to carlos@imoveauto.com for resolution. (4) All refunds are returned to the original credit card.
(O) DEPOSIT NON-REFUNDABLE POLICY
(1) I understand my deposit is non-refundable when I cancel or when I put the order on hold for any reason AFTER dispatch occurs. (2) However, when the order is placed on hold by me, the deposit shall be used as credit for my next shipment. (3) If I cancel, I understand my deposit may be used to pay for the carrier’s gas and time due to the cancellation or no-show. (4) I understand my deposit is non-refundable, if at pickup, the carrier is not able to load the vehicle(s) onto the truck using the vehicle's own power due to some mechanical, electrical, or any other problem with the vehicle(s), including modifications, or due to additional length, width, height or weight. (5) However, if the original carrier cannot load the vehicle(s), the deposit can be used as credit for the next carrier assigned and/or for the next shipment. (6) I understand my deposit is non-refundable, when I use the services of another broker by having him/her post my vehicle(s) on the Central Dispatch load board or when another broker finds another carrier on my behalf. (7) I understand my deposit is non-refundable when the carrier damages my vehicle or is delayed for any reason, since the carrier is the only liable party in these events. See (R): LIABILITY (8) I understand my deposit is non-refundable to cover additional costs such as: hotel stay, renting a car, storage fees or any other type of additional fees. See (U): ADDITIONAL FEES.
